 Landlord tip
  If your proposed tenant is under 18 years of age they are a minor. They cannot make financial contracts as they can later claim they did not understand the contract you signed with them. There are 2 main Acts in law which you should use as your guide.. Minor’s Contracts Act 1969 and the Residential Tenancies Act 1986  

 Two possible solutions. Get ratification through the Tenancy Tribunal where a mediator will ratify that they understand, or alternatively have a parent or guardian as guarantor by adding their name to the Tenancy Agreement .

  One of the databases we search for you is LTNZ Driver’s License national database. BUT... we can only supply this check if you have inputted the DL three digit version number into the search page. (5B on a Driver’s License). We suggest you make a space for this Version number on your Application form so you remember to collect it prior to your TINZ check.
 Since 1/4/12 The Office of the Privacy Commissioner has required you positively identify your prospective tenant before doing a credit check. If you check someone without their photoID being presented you are potentially breaching the privacy of the person whose non-photoID has been presented to you. Maximum $2000 fine.
 If you input a valid driver’s licence which you have visually compared with the prospective tenant in front of you then you have done enough to satisfy the OPC. Upload a photo of it to TINZ and that is proof you saw the photoID … and we will give you a credit.
 Don’t rely on the tenant giving you the details via phone or via on-line application form. Who knows it could be their sister or brother, who has good credit, whose photoID they have given unless you do the visual examination.
 Birth certificates and WINZ customer cards should not be considered photoID due to the many incidences seen of them being swapped.
